The North Gauteng High Court on Friday dismissed with costs the National Prosecuting Authority’s (NPA) application for leave to appeal in the matter relating to President Jacob Zuma's corruption charges.


The Democratic Alliance (DA) had earlier on Friday said it was “confident” that the court will "come to a favourable finding by dismissing the NPA’s and Zuma's application when it hands down judgment”.

The DA was opposing an application for leave to appeal by the NPA an April judgment that set aside Mpshe’s decision to discontinue Zuma’s prosecution on numerous counts of corruption and racketeering.

The party had submitted‚ before the full bench of the high court in Pretoria‚ that the decision in 2009 by Mokotedi Mpshe‚ then acting national director of public prosecutions‚ to discontinue the prosecution of Zuma was irrational.

Mpshe discontinued the prosecution of Zuma because he believed the Scorpions boss‚ Leonard McCarthy‚ had manipulated the timing of when to serve the indictment against Zuma.

In dismissing the application‚ Deputy Judge President Aubrey Ledwaba said the arguments raised by the NPA and Zuma were irrelevant and had no merit.

He said the NPA could not use the intercepted conversations as a basis to withdraw the case against Zuma.

He also said the NPA and Zuma invented novel legal grounds as they sought to apply for leave to appeal against the April judgment.

He also said there were no questions of law that needed to be dealt with by the Supreme Court of Appeal.

The court said setting aside of the withdrawal of charges against Zuma meant the charges were fully reinstated. - TMG Digital
