Three expelled Economic Freedom Fighters MPs will today file an urgent court application in an attempt to have their expulsion from their party and removal from parliament set aside.

The EFF expelled Mpho Ramakatsa, Andile Mngxitama and Khanyisile Litchfield-Tshabalala earlier this month.

Another rebel MP, Lucky Twala, was slapped with a lenient sentence. His membership was suspended for three years and he was ordered to apologise to the party.

Last week, parliament announced the expelled trio were removed as MPs from the House.

Mngxitama yesterday told The Citizen their removal from parliament had deprived them of the right to appeal their expulsion from the EFF.

“We had a period of 20 days to appeal the expulsion (from the EFF). This right is in the code of conduct, but that right was taken away from us,” said Mngxitama.

“We are still EFF members. We dispute the process that led to our … removal from parliament. The EFF must not issue instructions to the Speaker [Baleka Mbete], and the Speaker must not take instructions from the EFF.”

Mngxitama said the EFF had until April 4 to respond to the three MPs’ application, filed in the South Gauteng High Court last month, seeking to set aside the outcomes of the party’s national conference. The party had asked for an extension. It was granted but the MPs were still expelled.

The four were suspended by the party early this year after they publicly disputed the outcomes of the organisation’s national conference in Bloemfontein the same month, when Julius Malema was re-elected EFF leader.

Parliament spokesperson Luzuko Jacobs said the institution took a decision to remove the MPs after communicating with the EFF. The EFF could not be reached for comment.
