A 38-year-old man who is accused of raping his 15-year-old niece claimed she seduced him after she found him masturbating in the bathroom.
Justice Ncube of Mkhosana Township, who appeared in court this week, denied raping the Form 3 girl claiming that she is the one who entered into the bathroom while he was naked.
“I did not rape her, she is the one who entered the bathroom and found me masturbating and we had consensual sex,” he said.
But prosecutor Listen Nare sought to prove that Ncube pounced on his niece on Friday last week.
“On November 28 at 10am the complainant was in the bathroom when the accused locked the door before going into his room. While in his room he stripped naked and waited for her to come out,” he said.
It is alleged that Ncube dragged the girl into his bedroom where he forcibly laid her on the bed and removed her undergarments before raping her once.
“The complainant screamed but no one came to her rescue,” said the prosecutor.
The prosecutor said after the alleged rape, the girl told the shameless uncle that she was going to report him to her mother who then accompanied her to the police.
The magistrate, Sharon Rosemani, on Wednesday granted Ncube $400 bail and remanded him to December 12.
He was ordered to report at Vitoria Falls Police Station once every
week, surrender his travel documents.
