The Parliamentary Portfolio Committee on Media, Information and Broadcasting Services (PPCMIBS) on 19 March 2015 gave the Zimbabwe Broadcasting Corporation (ZBC) two weeks within which to present its forensic audit report to the Committee.
The forensic audit was commissioned by the Ministry of Media, Information and Broadcasting Services in February 2014.
Committee chairperson Honourable William Dhewa, issued the two-week ultimatum after ZBC board chairperson Father Fidelis Munyoro, informed the Committee that he could not provide the report without the approval of the responsible minister, Professor Jonathan Moyo.
Father Munyoro said that Professor Moyo had instructed his board not to release the report and recommended that if the PPCMIBS was interested in the report, it should summon the minister to appear before the Committee. The Committee, was however, not amused by that position.
Hon. Dhewa referred the ZBC delegation to Section 119: 1-3 of the Constitution of Zimbabwe and Section 13: 1-2 of the Privileges, Immunities and Powers of Parliament Act which confers the Parliament of Zimbabwe with oversight role on the State in upholding the Constitution.
Section 119 of the Constitution of Zimbabwe Amendment (No.20) Act 2013 reads:
1. Parliament must protect this Constitution and promote democratic governance in Zimbabwe
2. Parliament has power to ensure that the provisions of this Constitution are upheld and that the state and all institutions and agencies of government at every level act constitutionally and in the national interest
3. For the purposes of subsection (2), all institutions and agencies of the State and government at every level are accountable to Parliament
Hon. Dhewa stated that: “Reading together with Section 119 of the Constitution, Section 13: 1-2 stipulates that when you are making submissions before the committee you must submit documents or an article as requested by the same as long as the matter is not before the High Court. In this case the document we have requested for is not before the High Court…”
In his presentation before being dismissed by the Committee for failing to present the audit report, Father Munyoro said ZBC was to still come up with its Strategic Plan adding that the state-controlled broadcaster had a debt of $52 million.
Father Munyoro was accompanied by board member Dr Charity Manyeruke and acting chief executive officer, Patrick Mavhura.
