TWO Nkulumane teenagers landed themselves into trouble after they allegedly indulged in sexual activities before the age of 18. The two allegedly agreed to sleep together after they had attended a party on Christmas Day last year.

The 17-year-old boy was charged for engaging in sex with a young person under Section 70 of the Criminal Law (Codification and Reform) Act.

He appeared before Western Commonage magistrate Tancy Chipumha Dube where he pleaded not guilty to the charge, claiming the girl (16) had told him she was 18 years old.

He was remanded out of custody on free bail to January 28 for continuation of trial.

“When I met this girl, she told me that she was 18 years old and I actually thought she was even older than me,” the boy said.

“I took her to my home and we agreed to sleep together and I thought we would not have any problems since she was over 18.”
Prosecutor Mufaro Mageza told the court that the juveniles went on a partying spree on December 25 and when they both got drunk, they headed to the boy’s home where they had sex.

The girl agreed before the court that she had lied about her age to the boy, claiming she thought she was older than him.

“I never wanted to tell him my actual age since I thought he was way older than me,” the girl said. “He did not rape me.

“Although I was drunk, I remember we both agreed to engage in sex that night.”

The two were caught by the girl’s mother, who was tipped off by her child’s friends, who directed her to where her daughter was had been last seen.

She reported the matter to the police, leading to the boy’s arrest.
