The late musician Biggie Tembo’s son, who is named after his father, was yesterday convicted and sentenced to three months in prison for assaulting his five-month pregnant tenant. However, Mbare magistrate Ms Precious Muzondo, wholly suspended the sentence for three years on condition of good behaviour.
In passing sentence, Ms Muzondo indicated that Tembo (26) was a first offender and a non-custodial sentence was appropriate.
“In assessing sentence, I have considered that you are a first offender and it is the court’s duty to make sure that first offenders are kept out of prison where ever necessary,” she said.
Allegations are that on January 20 around 8 am, Brenda Marimo arrived at home from the shops and Tembo started insulting her using vulgar words.
The court heard that he ordered her to vacate his mother’s house and was enraged when Marimo tried to respond to his insults. He then punched and kicked her.
It is alleged that Marimo, who sustained injuries on her back and stomach, was rescued by Tembo’s mother.
Marimo made a report to the police leading to Tembo’s arrest.
