AN 18-year-old woman from Nkulumane suburb in Bulawayo has filed attempted rape charges against her cousin (17), who allegedly tried to be intimate with her while she was sleeping after they had finished studying.
The boy reportedly approached his cousin last week, requesting they study together overnight since they were both sitting for ‘O’ Level examinations. The boy appeared before the Western Commonage magistrate Tancy Chipumha-Dube where he was charged for contravening Section 67 of the Criminal Law (Codification and Reform) Act.
He was charged with indecent assault after he told the court that he did not rape his cousin, but admitted he slept on her bed.
“I did not rape her, although I admit I was nak*d in her bed,” the boy said.
“I felt sleepy and I joined her in bed.”
He was remanded out of custody to November 28. Prosecutor Kenneth Shava told the court that the boy went to his cousin’s bedroom and requested that they study together in preparation for the examinations.
At around 9pm, after their guardians were asleep, he knocked on the door and his cousin opened for him. He then said he was attracted to her and wanted to make her his girlfriend.
The complainant said her cousin told her she was s*xy and she thought that he was just complimenting her.
“After some time, I felt drowsy,” she said. “I told him to switch off the lights after he was done reading and asked if he could wake me up around 2am so I could continue studying.
“In the midst of sleep, I felt him fondling me while he was on top of me nak*d.”
She said her cousin had also managed to strip her. She said she immediately jumped off the bed and switched on the lights before notifying the guardians who tried to brush aside the issue, but she reported the matter to the police.
